Box 65, Lyndhurst, New Jersey 07071.This is a legal agreement ("Agreement") between you and Artemis Enterprises, LLC/RecoveringMates.Com. Please read the Agreement carefully before registering for and/or using RecoveringMates.Com. By registering for RecoveringMates.Com., you become a "user" of the service, and you agree to be bound by the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a user. MINORS MAY NOT BECOME USERS. When you register, and from time to time thereafter, Artemis Enterprises, LLC/RecoveringMates.Com., will require that you provide sufficient information to indicate that you are at least 21 years old. By becoming a user, you represent and warrant that you are at least 21 years old.
RECOVERINGMATES.COM. is currently provided as a service to users who agree to abide by the terms and conditions of the Agreement. RecoveringMates.Com. reserves the right to change the nature of this relationship at any time. Users who violate the terms of the Agreement may be banned permanently from using RecoveringMates.Com.
RECOVERINGMATES.COM. is a commercial web site, established by Artemis Enterprises, LLC. This is not a public network. Your right to speak freely here must be exercised with courtesy and self-restraint. When you enter RecoveringMates.Com., it is the same as entering any real privately owned facility, like an office, restaurant, theater, or shopping mall. The manners of real life apply, and we have the right to remove you if you violate the terms of the Agreement. We remind all of our users that you are entirely responsible and liable for all activities conducted by you on RecoveringMates.Com.
Either you or Artemis Enterprises, LLC, may terminate your RecoveringMates.Com. registration at any time, for any reason, effective upon sending written notice to the other party. Artemis Enterprises, LLC, reserves the right to immediately suspend or terminate your access to RecoveringMates.Com., without notice, upon any breach of this Agreement by you which is brought to the attention of Artemis Enterprises, LLC. Your registration for RecoveringMates.Com., is for your sole, personal use. You may not authorize others to use your registration or identity, and you may not assign or otherwise transfer your account to any other person or entity.
ONLINE CONDUCT . As a user you agree that:
1. You are solely responsible for the content or information you publish or display (hereinafter, "post") on RecoveringMates.Com. or transmit to other users.
2. You will not post on RecoveringMates.Com., or transmit to other RecoveringMates.Com. users or Employees, any defamatory, inaccurate, abusive, tasteless, obscene, profane, offensive sexually oriented, threatening, harassing, illegal material, or any material the infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
3. RecoveringMates.Com. welcomes adults of all ages, races, religions, genders, national origins, sexual orientations and points of view who are or have been in recovery. You will not post on RecoveringMates.Com., or transmit to other RecoveringMates.Com. users or Employees, any expressions of bigotry, hatred, harassment or abuse, nor will we tolerate threats of harm to anyone.
4. You will use RecoveringMates.Com. in a manner consistent with any and all applicable laws and regulations. We will not allow any illegal activities. Specifically, we will not let you advocate illegal conduct, or participate in illegal or fraudulent schemes.
5. You will not include in your profile or chat room designation any telephone numbers, street addresses, last names, URL's, E-mail addresses, offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post or swap any photos containing nudity or personal information. Artemis Enterprises, LLC reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions. By uploading a photo to RecoveringMates.Com. you affirm that the photo is a likeness of you.
6. You may not impersonate or assume the identity of someone else.
7. You may not stalk other users of RecoveringMates.Com. We reserve the right to release information to the proper authorities in the event of a reported stalking or other serious or unlawful act if the information is subpoenaed or if we deem it necessary and/or appropriate.
8. We encourage chat room participants not to give telephone numbers, street addresses, last names, URL's, e-mail addresses, passwords or other personal identifying information to anyone else while in a chat room.
9. You will not engage in advertising to, or solicitation of, other users to buy or sell any products or services through RecoveringMates.Com. You will not transmit any chain letters or junk E-mail to other RecoveringMates.Com. users.
10. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, intellectual property or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
11. You are solely responsible for your interactions with other RecoveringMates.Com. users. Artemis Enterprises, LLC reserves the right, but has no obligation, to monitor disputes between you and other users.
12. You may not post or use computer programs in connection with your use of RecoveringMates.Com. that contain destructive features, such as viruses, worms, Trojan horses, etc. We also do not allow any bots or scripts on the server, whether they are benign or destructive in intent.
13. You also may not engage in any disruptive conduct on RecoveringMates.Com. including, but not limited to, the following: persistent off topic comments in a topic oriented chat room, statements that incite others to violate a law or city ordinance, or the physical act of "scrolling"- repeatedly hitting the Return key in a chat conference.

INDEMNITY BY USER . You will defend, indemnify, and hold harmless Artemis Enterprises, LLC, its officers, directors, employees, agents, subsidiary companies and affiliated companies or persons and third parties, from and against any and all claims, losses, costs, liabilities, damages, and/or expenses (including reasonable attorneys' fees) relating to or arising out of your use or participation in this service or the information contained therein of RecoveringMates.Com., including any breach by you of the terms of this Agreement.

PLEASE READ THIS: It is possible that other RECOVERINGMATES.COM. users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on RECOVERINGMATES.COM. , and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the Service, and that the recipient may use such information to harass or injure you. Artemis Enterprises, LLC is not responsible for the use of any personal information that you may choose to disclose on RecoveringMates.Com. Please carefully select the type of information that you post on RECOVERINGMATES.COM. for release to others.
ARTEMIS ENTERPRISES, LLC RESERVES THE RIGHT, BUT HAS NO OBLIGATION, TO MONITOR THE MATERIALS POSTED IN THE PUBLIC AREAS OF RECOVERINGMATES.COM., OR TRANSMITTED WHILE ENGAGING IN CHAT(S). ARTEMIS ENTERPRISES, LLC SHALL HAVE THE RIGHT TO REMOVE ANY SUCH MATERIAL THAT VIOLATES, OR IS ALLEGED TO VIOLATE, THE LAW OR THIS AGREEMENT. NOTWITHSTANDING THIS RIGHT OF ARTEMIS ENTERPRISES, LLC YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST IN THE PUBLIC AREAS OF THE SERVICE, YOUR PRIVATE E-MAIL OR INFORMATION TRANSMITTED DURING CHAT(S). E-MAILS AND PRIVATE CHAT(S) BETWEEN YOU AND OTHER RECOVERINGMATES.COM. USERS THAT ARE NOT READILY ACCESSIBLE TO THE GENERAL PUBLIC WILL BE TREATED AS PRIVATE BY ARTEMIS ENTERPRISES, LLC TO THE EXTENT REQUIRED BY APPLICABLE LAW.
PROPRIETARY RIGHTS . Artemis Enterprises, LLC owns and retains other proprietary rights in the RecoveringMates.Com. service. The Service contains copyrighted material, trademarks, and other proprietary information of Artemis Enterprises, LLC and its licensors. In addition, other users may post copyrighted information, which as copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
By posting or transmitting information, a photograph or content to any public area of RecoveringMates.Com., you automatically grant, and you represent and warrant that you have the right to grant, to Artemis Enterprises, LLC and other RecoveringMates.Com. users, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
INFORMATION SUPPLIED BY USER. Artemis Enterprises, LLC will keep confidential all information supplied by you to Artemis Enterprises, LLC/RecoveringMates.Com., and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

SERVICE ON AN "AS IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO ANY COMMUNICATION WITH ARTEMIS ENTERPRISES, LLC/RECOVERINGMATES.COM. OR ITS REPRESENTATIVES, OR OTHERWISE WITH RESPECT TO THE SERVICE. ARTEMIS ENTERPRISES, LLC SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. ARTEMIS ENTERPRISES, LLC DOES NOT WARRANT THAT YOUR USE OF RECOVERINGMATES.COM. WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, OR ERROR-FREE, OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
LIMITATION OF LIABILITY. IN NO EVENT WILL ARTEMIS ENTERPRISES, LLC AND/OR RECOVERINGMATES.COM, AND/OR ANY OF THEIR SUBSIDIARY COMPANIES OR AFFILIATES, BE LIABLE (I) TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO US RECOVERINGMATES.COM. EVEN IF ARTEMIS ENTERPRISES, LLC OR ITS AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR (II) TO ANY PERSON OTHER THAN YOU OR (III) TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGES THAT MAY RESULT FROM OR OCCASIONED BY THE USE OF THIS SERVICE, INCLUDING BUT NOT LIMITED TO CLAIMS FOR DEFAMATION, LIBEL, SLANDER, ECONOMIC LOSS, BODILY INJURY, ILLNESS OR DEATH, OR (III) TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGES THAT MAY RESULT FROM OR OCCASIONED BY THE USE OF THIS SERVICE, INCLUDING BUT NOT LIMITED TO CLAIMS FOR DEFAMATION, LIBEL, SLANDER, ECONOMIC LOSS, BODILY INJURY, ILLNESS OR DEATH OR (IV) TO YOU FOR ANY LOSS OR DAMAGES, EITHER ACTUAL OR CONSEQUENTIAL, ARISING OUT OF OR RELATING TO THESE TERMS, OR TO YOUR (OR ANY THIRD PARTY'S) USE OR INABILITY TO USE A SITE, OR TO YOUR PLACEMENT OF CONTENT ON A SITE, OR TO YOUR RELIANCE UPON INFORMATION OBTAINED FROM OR THROUGH A SITE; IN PARTICULAR, BUT NOT BY WAY OF LIMITATION, RECOVERINGMATES.COM WILL HAVE NO LIABILITY FOR ANY CONSEQUENTIAL, INDIRECT, EXEMPLARY, SPECIAL OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OR INABILITY TO USE A SITE, OR TO YOUR PLACEMENT OF CONTENT ON A SITE, OR TO YOUR RELIANCE UPON INFORMATION OBTAINED FROM OR THROUGH A SITE, WHETHER BASED IN CONTRACT, TORT, STATUTORY OR OTHER LAW.
IN ADDITION, ARTEMIS ENTERPRISES, LLC DISCLAIMS ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER USERS (INCLUDING UNAUTHORIZED USERS, OR "HACKERS") OF RECOVERINGMATES.COM.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ARTEMIS ENTERPRISES, LLC'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO ARTEMIS ENTERPRISES, LLC/RECOVERINGMATES.COM., FOR THE SERVICE DURING THE TERM OF USAGE.
STATE BY STATE VARIATIONS. Certain jurisdictions limit the applicability of warranty disclaimers and limitations of liability so the above disclaimers of warranty and limitations of liability may not apply to you.
GENERAL PROVISIONS. This Agreement is entered into in Lyndhurst, New Jersey. You agree that New Jersey law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the federal and state courts in Newark, New Jersey. This Agreement, accepted upon registering for and/or using RecoveringMates.Com., contains the entire agreement between you and Artemis Enterprises, LLC regarding the use of RecoveringMates.Com. This Agreement may only be amended upon notice by Artemis Enterprises, LLC/RecoveringMates.Com., to you, or by a writing signed by you and an authorized official of Artemis Enterprises, LLC. Unless otherwise explicitly stated, the Terms will survive termination of your registration to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
